These Terms & Conditions ("Terms") govern your access to and use of the website located at https://www.clickandmortarinvestments.com (the "Site"), our property submission forms, our phone and SMS/text-message communications, and any related services (collectively, the "Services") provided by Click and Mortar Investments LLC ("we", "us", or "our"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Who We Are

Click and Mortar Investments LLC is a private real estate investment company that purchases houses and land directly for cash. We are not a real estate agent, broker, lender, attorney, accountant, or financial advisor, and nothing on the Site constitutes legal, tax, or financial advice. You should consult your own professionals before making decisions about your property.

2. No Offer Until Written Agreement

Estimates, ranges, or numbers discussed on the Site, by phone, by text, or by email are preliminary and non-binding. A purchase offer is only valid when set forth in a written purchase and sale agreement signed by both parties. We may modify or withdraw any preliminary number at any time prior to a signed agreement based on title, condition, market, or other factors.

3. Information You Submit

By submitting your name, phone number, email, property address, or other information through any form on the Site, you represent that the information is accurate and that you are the property owner or are authorized to act on the owner's behalf. You authorize us to contact you about your property at the phone number(s) and email address you provide, including by automated means, prerecorded voice, email, and SMS/text messages, even if your number is on a state or federal Do-Not-Call list. Consent to contact is not a condition of any purchase.

4. SMS / Text Messaging Program (10DLC)

Our SMS program is operated in compliance with TCPA, CTIA messaging guidelines, and 10DLC carrier requirements. Full program details are on our SMS Terms page. The summary below is incorporated into these Terms.

  • Program name: Click & Mortar Seller Communications.
  • Program description: One-to-one conversational messages between you and a representative of Click and Mortar Investments LLC regarding the sale of your property, including offer follow-up, scheduling, document delivery, and closing coordination. We do not send marketing blasts and we do not share or sell your mobile information or opt-in data to third parties or affiliates for marketing or promotional purposes.
  • How you opt in: By (a) submitting a form on the Site with your mobile number, (b) texting us first, or (c) replying anything other than STOP after we contact you, you provide your prior express written consent to receive SMS messages from Click & Mortar at the mobile number provided.
  • Message frequency: Recurring, conversational; typically 2–10 messages per active transaction. Frequency varies based on your responses.
  • Message and data rates: Message and data rates may apply. Check with your mobile carrier.
  • Opt out: Reply STOP at any time to any text from us to unsubscribe. You will receive one final confirmation message and no further texts will be sent.
  • Help: Reply HELP for assistance, or contact us at 833-388-5683 or use our contact form.
  • Supported carriers: All major US carriers including AT&T, Verizon Wireless, T-Mobile, Sprint, US Cellular, Boost, Cricket, MetroPCS, and others. Carriers are not liable for delayed or undelivered messages.
  • Privacy: See our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing is limited to subcontractors that support the messaging program (e.g., messaging platform, CRM), and these subcontractors are contractually prohibited from using the data for their own marketing.

5. Phone Calls and Call Recording

By providing your phone number, you consent to receive calls from us, including calls made with an automatic telephone dialing system or artificial/prerecorded voice. Calls to or from us may be monitored or recorded for quality, training, and compliance purposes where permitted by law. If you do not consent to recording, please notify the representative on the call.

6. Acceptable Use

You agree not to:

  • Submit false, misleading, or fraudulent property or contact information.
  • Submit information about a property or person without proper authority.
  • Use the Services to harass, abuse, or threaten any person.
  • Interfere with, probe, scan, or test the vulnerability of the Site or any related system.
  • Use automated tools, scrapers, or bots to access the Site without our prior written consent.

7. Intellectual Property

All content on the Site — including text, graphics, logos, photos, and software — is owned by Click and Mortar Investments LLCor its licensors and is protected by US and international intellectual property laws. You may view and print pages from the Site for personal, non-commercial use only.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CLICK AND MORTAR INVESTMENTS LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

10. Indemnification

You agree to defend, indemnify, and hold harmless Click and Mortar Investments LLC and its members, managers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services or breach of these Terms.

11. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in San Joaquin County, California, and you consent to the jurisdiction and venue of those courts.

12. Changes

We may update these Terms from time to time. The "Last updated" date above will reflect the most recent revision. Continued use of the Services after changes are posted constitutes acceptance.
